Statement on Implementation and Administration of the GATT Agreement



1. Description of relevant laws, regulations and administrative orders relating to implementation and administration of Technical Barriers to Trade. All necessary references should be provided.  

The laws of Ukraine cover the following areas:  
  • Consumer Protection, 
  • Protection of Labor, 
  • Sanitation and Disease Control, 
  • Energy Conservation, 
  • Data Security in Automated (Computer) Systems. 
These laws establish the procedure for enacting compulsory requirements in the technical regulations concerning: national safety, accurate information, human health and safety, animal and plant life, and environmental protection. These laws comply with the requirements stipulated in article 2 (p.2.1) of the Agreement on Technical Barriers to Trade. 

The following legislation of the Cabinet of Ministers, adopted in 1993 and ratified by the Supreme Rada (Parliament) of Ukraine, specifies basic provisions concerning the implementation of standardisation and conformity assessment (certification) activities. This legislation carries the full weight of the law of Ukraine. 
  • "On Standardisation and Certification" 
  • "On Ensuring Uniformity of Measurement" 
  • "On State Supervision of Adherence and Enforcement of Standards and Regulations" 
These laws constitute a legal framework for governmental policy in the areas of standardisation conformity assessment (certification), measurement uniformity, and product packaging and labeling. These laws do not establish the specific technical requirements, and as such, do not directly create technical barriers to international trade. 

The State Committee of Ukraine on Standardisation, Metrology and Certification, Derzhstandard of Ukraine, has developed and approved the national standards (DSTU) of the state standardisation system on the basis of the above legislative acts. They establish the general principles of standardisation in addition to the categories of normative documents on standardisation; types of standards; and the general order of standards development, their formulation, structure and contents, and the basic provisions concerning implementation and supervision of their adherence.  

The requirements of the state system on standardisation are harmonized with the requirements of the international standards organizations ISO and IEC considering the following principles:  

(1) openness and transparency of current standards and standards under development; 

(2) participation in the development process by all interested (including foreign) parties;  

(In general, the development of standards is accomplished by technical committees (TC), which consisting of specialists from workers, producers, consumers and state supervision bodies on a voluntary basis.)  

(3) harmonization with international standards; 

(4) adoption of standards on the basis of consensus. 

In accordance with the state system for standardization of Ukraine, national standards of Ukraine shall contain both compulsory requirements (concerning product safety and environmental protection) and recommended requirements.  

Technical regulations of the state system for certification (UkrCEPRO) have been developed in compliance with ISO/IEC requirements (ISO/IEC 2, ISO/IEC 25, ISO/IEC 39, ISO/IEC 40), and are also consistent with ISO/CASCO directives. They provide for product conformity assessment to compulsory standards. In accordance with UkrCEPRO requirements, conformity assessment procedures shall be applied uniformly to foreign and domestic products. Unfavorable treatment shall not be applied to foreign products. 

The Decree of the President of Ukraine, dated 19 February 1996, number 135/96 "On the Interdepartmental Commission on Ukraine's Accession to the General Agreement on Tariffs and Trade and the World Trade Organization" provides for compulsory verification that draft legislative acts concerning the reformation of Ukrainian foreign trade meet the requirements of GATT/WTO.

Derzhstandard of Ukraine issues its work plans and programs on standardisation in the periodical "Bulletin of Information Materials on Standardisation Metrology and Certification." 

A list of the national technical regulations under development is published in the official edition of Derzhstandart of Ukraine

Interested parties may obtain draft standards during any stage of development from the Ukrainian Research Institute for Standardisation, Certification and Information Science (UkrNDISSI). This national institute performs preparation and verification of draft standards for approval.

Comments and written statements will be considered on draft national standards for sixty days following issuance of the draft standard. 

Draft standards are also published in professional journals and literature (e.g. "Food Industry of Ukraine" and "Metals and Casting of Ukraine") to attract feedback for development of national standards in those specific areas. 

(b) Names and addresses of the enquiry points provided for in articles 10.1 and 10.3 of the WTO agreement on Technical Barriers to Trade (Hereafter referred to as Agreement) with an indication as to whether it is fully operational; 

The Ukrainian National Information Center for Standardisation and Certification of the International Information Network (ISONET) is an integral part of the National Automated Information Depository of Standards established by the government of Ukraine in February 1995. Currently, the National Information Center is not fully operational. The National Information Center plans to become partially computer automated by the fourth quarter of 1996. 

Derzhstandard of Ukraine has Membership 1 status in ISONET.

This center operates under the auspices of the Main Depository of Standards, an office of the National Automated Information Depository of Standards.

Derzhstandard of Ukraine conducts consultations and settles disputes concerning standardisation and procedures for conformity assessment.

(e) The scope of responsibility of national governmental authorities (or authorities if the responsibility is divided) concerning the notification requirements foreseen in article 10.11 of the Agreement; 

Derztandart of Ukraine is the sole governmental authority responsible for implementation on the national level of provisions relating to notifications in accordance with the Agreement. 

(f) Measures or arrangements to ensure that national or local authorities preparing new technical regulations or substantial amendments to existing ones, provide early information on their proposals; 

Derzhstandart is the central authority of the state executive branch which determines the goals, administration and rules for implementation of standardisation, metrology and conformity assessment (certification). All work in the area of technical regulations, standards development, and amendments to existing standards has been accomplished by 111 national technical committees on standardisation on the basis of annual standardisation plans prepared, adopted and supervised by Derzhstandart with the participation of all interested parties. 

The Cabinet of Ministers of Ukraine has established a Interdepartmental Council on Standardisation, Metrology and Certification, to co-ordinate work on the state, regional and local levels, and to ensure the conformity and uniformity of each region's actions. Among the responsibilities of this interdepartmental council is the assurance of uniformity of all standardisation measures.  

The "Provision on National Information Center on Standardisation and Certification" (Information Center GATT/WTO) adopted by the government of Ukraine, requires all authorities involved in the preparation of new technical regulations and substantive amendments to existing regulations to provide early information on their plans as required by the Agreement. 

In addition, the state system for standardisation of Ukraine provides for a state registration of all national standards of Ukraine, sector standards (operating in specific industrial sectors), scientific and technological organisation standards (voluntary standards developed by tech. organisations) and technical regulations of Ukraine (operating within specific enterprises including private ones). Standards, technical regulations and their amendments that have not been registered by Derzhstandart of Ukraine are not valid. Registered standards are listed in the state register.
