She has been in the US for four years prior to getting married on an F-1 visa (we got married two weeks after her visa expired).
The difficulty is in traveling with US documents that say her married name and an international passport from Ukraine that still has her maiden name. The consulate in Chicago reccommended getting 2 one way tickets (to Ukraine with maiden name and to US with married name) and trying to get a new passport while in Ukraine.
Would it be a problem to buy a round trip ticket in her married name and show her marriage license (translated, notarized by the consulate)?
: Please be aware of the fact that if a person who is not a permanent resident has been present unlawfully in the US more than 180 consecutive days or more than 360 days in the aggregate since 1997 and then leaves the US, s/he will face a 3-yr or a 10-yr bar to re-entry, despite the advance parole.
: For persons with past unlawful presence, it's better to wait for the grant of permanent residence before leaving the US. Waivers of the 3-year and the 10-year bars are really hard to get.
