She must to gotten back in US on an illegal way. The point is, she is not saying the whole story. As far as the baby goes, if the baby was born in the US, he is a US citizen. I'm from Venezuela, which must be the country you are saying she is from. I know the whole process "in the very legal way" since my husband is very concern of doing everything in the right way. I came with fiance visa, cause' he did the petition for me. Everything is being according to laws, sometimes long waiting periods but I go to my country at least twice a year with no problems. Something else is happening in that case "cause nobody is punished in that way because of using a false SS". The INS laws stipulate that an alien who use false documents become elegible for deportation procedures for misrepresentation. However, the husband and father of the baby should be looking for some advice since she wants to take the baby by herself. Uffff they obviously have a lot of issues to work in that relationship. Also I do not understand why they "together" haven't apply to get everything right in INS.
I wish good luck to the grandparents, they must feel awful and apparently they are the only ones with their heads on their shoulders.
