: Dear Ms. Durbak, could you help me please with your legal advise. I have H1-B visa and I have applied for the Labor Certification, so my file is still in the Labor Department but my H1-B will expire soon. Can I extend my visa for one year before my case go the INS? I know I can get an extension of my visa while case is pending in INS

If you write to me directly, I will answer your questions. I do not give information about specific cases on the bulletin board.
In general, it is possible to renew H-1bs until one has been in that status in the US for 6 years. Under certain circumstances, if one has a Labor Certification Application or an I-140 pending, it is possible to renew the H-1B for even longer. If you had an attorney handling your case until now, that is the best person to answer your questions, because s/he would know all of the details of your case. If you want to write to me, you need to give me more details. How long have you been in H-1B status? Were there any interruptions of that status? How long has the labor certification been pending?
