Hello Group:
I have been to Ukraine two times to be with my fiance. She has been sepaarted and living with parents for 2 years, but does not have her divorce yet. She worries (I worry) that husband (and father of her child) will refuse permission to allow child to emigrate to America with me. She wants divorce, but feels he will know that she is looking to leave UKraine.
My questions: How difficult is it to get divorced in Ukraine, with a child. Is the father needed to consent to divorce? Can she get divorce without him?
Also, should he refuse to allow the child to go with her to America, to be with me, would it be better for us to marry in Ukraine, to demonstrate that our bond is sound, and that I can tell UKranian court that I wish to adopt the child in America? I had heard that the K# visa, under the LIFE Act, now takes about as long as fiancee visa. Would getting married in UKraine be the best option, vs. going the fiancee visa route, and chancing that the father won;t give a permisiion letter at embassy in Warsaw?
Any thoughts or help is appreciated!
