: Hi!

: I have a question. I am a student of Berkeley College in NYC and I am still on tourist visa. I plan to come back to Poland (I am Ukrainian with polish residence card) and get my student visa in December. My tourist visa is not expired. Should I tell the counceler that I studied on my tourist visa and than before it expired I decided to change it to students' one? What should I say at all?

: Thanks. I appreciate your quick help

: My e-mail: bojkiw@yahoo.com

: Respectfully,
: Yuriy

Persons who are on a tourist visa may study in the US on a part-time basis. If someone on a tourist visa studies full time, that person violates the conditions of tourist (B-2) status and falls out of status.
One must answer all questions truthfully at the consulate. Yet, it is not necessary to answer questions which are not asked. Anyone who volunteers to a consular official that he or she has violated nonimmigrant status should not in most instances expect to get another nonimmigrant visa.
