My wife came to America from Lviv on a K. 1 Visa to marry a different person. This did not work out and she did not marry this man. I met her and shortly after that started courting her. We married 8 1/2 months after her K. 1 Visa expired. After we married we applied for permanent residence status for her. Her application for permanent residence status was denied. INS says she must leave America and apply again at the Ukrainian embassy in East Europe to change her status. The reason they denied her permanent residence application was because she did not marry the man who invited her here on the K. 1 Visa. Her I-130 application is okay. Can Tatiana B. Durbak or some attorney please give us advice? If someone could give us advice we would be very grateful.
