It depends where and when you are applying. If you are applying for a change of status through the Vermont Service Center, at present the actual time for the visa petition to be processed -- if there are no problems -- is about 6-8 weeks. However, the entire process takes longer, because it is necessary to get approval of a Labor Certification Application. Often, it is also wise to get a prevailing wage quote from the State DOL.
H-1 petitions should usually not be done without the help of a reputable attorney who is knowledgable about such petitions. A good source for attorneys is www.ilw.com.
