John: It depends upon the INS Service Center that has jurisdiction over your place of residence. Some of the centers like Mesquite, Texas or Nebraska, for example, have a very large caseload, and the Petition is not likely to be approved in less than 90 days. The last one we filed for one of our clients in the Nebraska Service Center was approved in about 80 days. We currently have one pending in the Texas service center for over 90 days. There may be reasons why your petition is not being approved as quickly as you would like. You have the burden of proof is establishing that you and your fiancee have met all of the legal requirements so that she can be classified as an Alien Fiancee, and therefore be eligible to apply for her K-1 non-immigrant visa at the US Embassy in Warsaw, Poland. There are some things that our office does to speed along the process along, but it appears that you have chosen to attempt to do the process by yourself presumably to save some money.
I wish you luck! My own fiancee lives in Dnepropetrovsk, Ukraine, and I just recently filed a package with the INS. I expect to have my own petition approved in about 15 to 30 days. Our office has representatives who work for us in Kiev and in Dnepropetrovsk. You will find the 2nd part of the process involving your fiancee's own application to be somewhat demanding. One of our clients had her interview on April 23rd, and she informed us that a lot of people were denied visas that day. That's why we feel it is important to have competent people working for us overseas...they assist the ladies with their paperwork, and we make sure they are prepared for the interview. I travel to Ukraine frequently, and I often meet with the ladies and make myself available to answer their questions. Many of these ladies are afraid of the process. I reassure them that there is nothing to be afraid of ...we just have to make sure that all the requirements have been met.
