: Last year I finished collage on F-1 visa and by mistake my lawyer applied on permanent residence status. Of course it was denied, because I wasn't qualified. Four months after denial, we applied for different status, asking them to exercise of the Service's discretion to forgive the lapse in my status. Today the Immigration Service has rejected the request to change my status. The denial simply says, based on your having been out of status, "the beneficiary does not qualify for a change of status in the United States and the petition must be denied."
: There is an option of filing a Motion to Reconsider the denial

: I'm wondering , if don't file a Motion to Reconsider, how many days i have to pack my bags and leave for Ukraine. Will I be penalized for 10 years not to come to the USA.
: What if i try to apply political pressure to have the case looked at a second time and, i hope, more favorably considered by a supervisory officer.
