Four months after denial, we applied for different status, asking them to exercise of the Service's discretion to forgive the lapse in my status. Today the Immigration Service has rejected the request to change my status. The denial simply says, based on your having been out of status, "the beneficiary does not qualify for a change of status in the United States and the petition must be denied."

: I'm wondering , if don't file a Motion to Reconsider, how many days i have to pack my bags and leave for Ukraine. Will I be penalized for 10 years not to come to the USA.
