I have the very same problem. Interesting but when I came I've been as not a subject, however beginning from the next IAP-66 and all followed DS-2019 forms were that I'm a subject. It sounds as bad luck. Anyway the Embassy said me they don't issue that letter anymore since 2001 and cited some "cirkular Ministerstva zakordonyh sprav vid lustpada 2001 r.", where (as they said) it's mentioned and this decision was based on Ukrainian Government (Kabinet Ministriv) decision. I still requested this info from MSC and Embassy however did not get any reply. So the only choice for you and me to prove hadship of your American spouse, to prove persecutions is waiting for you in Ukraine or to be recommended by US government Agency (not easy). The easiest way to go home for 2 years and never ever come back as J-1 visitor. In my case the worst thing that I have to prove to my boss that I’m leaving not because I want, but because some Ukrainian regulations I have no idea which exactly ones. So to be in good shape I will initiate my IGA waiver application, though I know that it’s almost lost-lost situation. So good luck for you and let me know if you found some way I don’t know (if you are not really greedy ;-)
