CBS 60 MINUTES "THE UGLY FACE OF FREEDOM"

STATUS OF SETTLEMENT
JUNE 10, 1999

During the last 4 and a half years, Alexander Serafyn, Oleg Nikolyszyn and the UCCA (the "Petitioners") had been involved in various legal proceedings at the FCC level and a successful appeal at the U.S Court of Appeals, District of Columbia Circuit, arising out of the CBS 60 MINUTES news segment "The Ugly Face of Freedom" In such news segment CBS engaged in alleged news distortions and misrepresentations to the viewing public. Such program caused an outcry in the Ukrainian American and Ukrainian viewing audience, including the commencement of the various administrative and legal proceedings.

In April, 1999, after a March 1, 1999 meeting between CBS legal counsel and producers and representatives f the Ukrainian American community, a Joint Petition for Approval of Settlement Agreement was filed by CBS and the Petitioners in an attempt to settle the case.

On June 17, 1999, the Mass Media Bureau of the Federal Communications Commission (FCC):

(i) granted the Joint Petition for Approval of Settlement Agreement between the "CBS Parties" (CBS and Westinghouse) and the "UCCA Parties" (Serafyn, Nikolyszyn and UCCA) under the terms of which the CBS Parties will pay counsel for the UCCA Parties $328,000 to reimburse legal expenses incurred in prosecuting the various petitions, complaints and appeals;
(ii) dismissed the UCCA Parties to any further proceedings regarding those matters. and
(iii) approved the Settlement Agreement in the form submitted.

In addition the June 7, 1999 decision provides that when the FCC so directs, CBS will file comments with the FCC requesting approval of the WGPR-TV (Detroit) and the WPRI-TTV (Providence, RI) assignment applications and addressing any questions that remain to be resolved in light of the District of Columbia Circuit’s remand of these proceedings. The UCCA Parties will not object to such filings on any matters raised in the above-noted proceedings or occurring prior to June 7, 1999.
